    Trai plans 'must-have' list for DTH

    DTH subscribers who are missing out on the India-Bangladesh Test series and other popular programmes simply because Tata Sky or Dish TV do not have an agreement with the concerned broadcasters may have reasons to cheer.

    The Telecom Regulatory Authority of India (Trai) is looking into the issue of having a ‘must carry’ clause in the DTH license. If implemented, this can lead to the regulator mandating carriage of ‘popular content’ by all existing DTH players.

    Currently, subscribers on the DTH platforms do not have a choice to select the channels that they want to watch.
    Trai sources told ET that the issue of introducing a ‘must carry’ clause as part of regulation was highly complicated and was currently being discussed with all stakeholders.

    “Last Friday, we had a meeting in Bhubaneswar with some stakeholders — more meeting is required before anything can be decided,” a Trai official said. The complications arise from the fact that before any such clause can be introduced, Trai must first bring about regulation that puts in place a standard interconnection agreement between all DTH players and broadcasters.

    This will ensure that no broadcaster can deny their channels to any DTH player. Besides, only when all channels are available can the regulator mandate which of them is to be carried, explained the Trai source. DTH operators are a divided lot with regard to the ‘must carry’ clause.

    While some like Tata Sky want Trai to change the licensing norms and introduce it, others like Sun Direct and Dish TV and Bharti have opposed the move. “Tata Sky has recommended mandating carriage of only popular content on the basis of viewer ship share as determined by independent monitoring agencies,” the company said.

    However, Sun, in its communication to Trai said: “Sun Direct feels that carriage of only popular content should not be mandated on the basis of viewer ship share as determined by independent monitoring agencies, because there is no prevalent external audit system of the monitoring agencies. In addition the meters are poorly distributed and concentrated in particular cable networks in a city.”

    At the same time, DTH operators have also pointed out that the number of channels has increased over last few years to such an extent, that it will no longer be technically feasible for them to carry all the channels. Trai, however, in its reply has said that this was yet another factor that may force it to intervene and mandate which channel is carried.

    No human wants will be satisfied ever. If one thing ends another one crop ups.
